These Terms & Conditions ("Terms") govern your access to and use of the eAcademy website at offer.eacademy.com.au (the "Site") and any tutoring or related services we provide ("Services"). By using the Site or engaging our Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.

1. About eAcademy

eAcademy is an independent online tutoring provider based in New South Wales, Australia. We are not affiliated with, endorsed by, or sponsored by the NSW Education Standards Authority (NESA), the NSW Department of Education, or any school referenced on the Site.

2. Eligibility and use by minors

The Services are designed for secondary school students, typically NSW Years 10–12. If you are under 18, you may only use the Site or engage the Services with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on the student's behalf and is responsible for all activity and payments associated with the account.

3. Enquiries, quotes and engagement

  • Submitting an enquiry or completing the "Find my program" form does not create a contract for Services. It is a request for a personalised quote.
  • All pricing displayed on the Site is indicative and clearly labelled as estimated. Final pricing depends on subjects, tutor allocation and schedule, and will be confirmed in your personalised quote.
  • A binding agreement for Services is formed only when you accept a written quote or service agreement and we confirm acceptance in writing (including by email).

4. Service delivery

Tutoring sessions are delivered online via video conferencing. You are responsible for providing a suitable device, stable internet connection and a quiet environment. We will make reasonable efforts to deliver sessions at the scheduled time but may, where unavoidable, reschedule with reasonable notice. Tutors are carefully selected for subject expertise; however, we reserve the right to change a tutor where necessary to maintain quality of service.

5. Fees, payments and refunds

  • Fees are payable in advance unless otherwise agreed in writing. All prices are in Australian dollars and are inclusive of GST where applicable.
  • Pay-as-you-go (PAYG) sessions: cancel or reschedule with at least 24 hours' notice for a full credit; later cancellations or no-shows are charged in full.
  • Semester programs: you may cancel before the start of Week 2 for a pro-rata refund of unused sessions. After Week 2, fees are non-refundable except where required by Australian Consumer Law or as expressly stated in your service agreement.
  • Where the Australian Consumer Law applies, nothing in these Terms excludes, restricts or modifies your statutory rights.

6. Conduct and acceptable use

You agree to use the Site and Services lawfully and respectfully. You must not:

  • Record, copy, redistribute or publish session content (audio, video, screen shares or materials) without our prior written consent;
  • Share access to your sessions, account or materials with anyone outside the enrolled student and parent/guardian;
  • Use the Site or Services to harass, abuse, defame or harm any person;
  • Interfere with, disrupt or attempt to gain unauthorised access to the Site or our systems; or
  • Use the Site or Services in breach of any applicable law.

We may suspend or terminate Services without refund for serious or repeated breaches of these Terms.

7. Intellectual property

All content on the Site and in our learning materials — including text, design, graphics, logos, video, audio, study plans, worksheets and exemplars — is owned by or licensed to eAcademy and protected by Australian and international copyright laws. You receive a limited, personal, non-transferable licence to use materials provided to you solely for the student's own study during the engagement. You may not reproduce, distribute, sell or create derivative works from any of our materials.

8. Results, testimonials and disclaimers

We work hard to support student progress, but academic results depend on many factors including attendance, effort and individual circumstances. We do not warrant or guarantee any particular ATAR, band, mark or outcome. Testimonials and reviews shown on the Site are genuine and sourced from public Google Reviews; they describe past experiences and do not guarantee future results.

To the maximum extent permitted by law, the Site and Services are provided "as is" and we exclude all implied conditions and warranties, except those that cannot lawfully be excluded.

9. Limitation of liability

To the maximum extent permitted by law, eAcademy's total liability to you for any claim arising out of or in connection with the Site or Services is limited, at our option, to either (a) re-supplying the affected Services, or (b) refunding the fees paid by you for the affected Services. We are not liable for any indirect, consequential, incidental, special or punitive loss or damage, including loss of opportunity, loss of marks or loss of profits. Nothing in these Terms limits any rights or remedies you have under the Australian Consumer Law that cannot lawfully be excluded.

10. Indemnity

You agree to indemnify and hold eAcademy harmless from any claims, losses, damages or expenses arising from your breach of these Terms, your misuse of the Site or Services, or your infringement of any third-party right.

11. Third-party links and services

The Site may include links to third-party websites or integrate third-party tools (such as video conferencing or messaging platforms). We are not responsible for the content, policies or practices of those third parties. Your use of third-party services is governed by their own terms.

12. Privacy

Our handling of your personal information is set out in our Privacy Policy, which forms part of these Terms.

13. Changes to these Terms

We may update these Terms from time to time. The current version is always available on this page, with the "Last updated" date shown. Continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and eAcademy submit to the non-exclusive jurisdiction of the courts of New South Wales.
